So I finally got a chance to put my hard top and steel doors on my 64 CJ5. The top came off of a 55 M38A1. Everything fit except for the rear hatch.
I assume because the M38A1 had no tailgate and since my CJ5 does and seeing as how the tailgate stands about 1/2 inch higher than the M38 tub space would be....it will not seal nor shut.
The rounded top of the tailgate needs to come down about 1/2 inch so my plan is to cut under the bottom underside of the tailgate all the way across and remove a 1/2 inch strip, then just bend or pound it back into place and hope this drops it by the amount I need to clear the hatch.

Wonder if anyone else has this combo and has any better ideas before I commence to cutting?

You should be able to adjust the tailgate down a little. The holes for the hinges have some play.

Stop, don't cut. What kind of hard top? I got two spare rear hatches, a Meyer and a Kelly.

in addition, the rear hatch has a little bit of adjustability also.

I will take some pics tomorrow and post up. I am uncertain of the make of the hardtop.

I will also look at the hinges. Not sure I can gain 1/2 but I'll look...thanks for the tips.
